Henvendelsen fra Jó Bernardo og Sérgio Vitorino fra Portugal, der nærer stor bekymring for den måde drabet den 22. februar 2006 på den 22 årige transseksuelle Gisberta omtales på i de portugisiske medier og den manglende forståelse for transseksuelles forhold, som tilsyneladende hersker i Portugal, og for, at drabssagen skal blive tiet ihjel.

De opfordrer derfor i den herunder gengivne skrivelse alle europiske transorganisationer til at få deres politikere til at lægge pres på Portugal, så drabssagen bliver hehandlet ordentligt.

På grund af:
  1. en grusom forbrydelse, som mere og mere ligner en “hadforbrydelse
  2. den ensidige udeladelse at de seksuelle og transfobiske elementer i sagen
  3. den usammenhængende reaktion fra majoriteten af LGBT foreninger i Portugal, som medvirkede til den enorme forvirring og desinformation i medierne, fordi de hverken evnede at informere korrekt om mordofferets identitet eller om forskellene mellem homofobi og transfobi
  4. mediernes og politikernes forsøg på at minimalisere forbrydelsen
  5. udeladelsen af had-komponeneterne i mordet på et menneske, som lider under så mange sociale problemer
  6. forsøget på at gøre offeret til den skyldige
  7. den offentlige neddyssen af denne sag

appellerer vi om omgående støtte fra alle LGBT foreninger og sammenslutninger over hele verden med det formål:
  1. på det skarpeste at tage afstand fra de faktuelle hændelser i Portugal, specielt indenfor foreningerne og indenfor såvel nationale som internationale media
  2. at protestere over den måde LGBT foreninger, offentlige myndigheder, politiske partier og media har behandlet denne sag
  3. at vise solidaritet overfor de kræfter, som forsøger at ændre denne dramatiske situation
  4. og at sætte maksimalt internationalt pres på Portugal.

KONKRET OM SAGEN
Den 22. februar 2006 blev den 22-årige Gisberta fundet død. Gisberta var brasiliansk indvandrer, transseksuel, HIV-smittet, narkoman, prostitueret og hjemløs.

Hun blev fundet i bunden af en 10 meter dyb brønd ved et ikke færdigt byggeri i Oporto, som er den næststørste by i Portugal. Forbrydelsen blev begået og tilstået af en gruppe på 14 drenge i alderen mellem 10 og 16 år, som for de flestes vedkommende
boede på en institution til beskyttelse af børn, ejet og drevet af den katolske kirke, men finansieret af staten.

Detaljer om den frygtelige forbrydelse er fremkommet gennem drengenes tilståelse.
Offeret havde et meget dårligt helbred, og hun blev ofte chikaneret af disse drenge med hån og tilråb.
Den 19. februar trængte en gruppe af disse drenge ind i den ufærdige og forladte bygning, hvor Gisberta levede, bandt hende, kneblede hende og overfaldt hende med ekstrem voldsomhed med spark, slag med slagvåben og stenkast. Gruppen har endvidere tilstået, at de sodomiserede Gisberta ved indførelse af forskellige instrumenter i hendes endetarm. Til slut efterlod de Gisberta kraftigt forslået og med mærker af cigaretgløder over hele kroppen.

Den 20. og den 21. februar 2006 vendte de tilbage og gentog mishandlingen. Ved daggry natten mellem den 21. og den 22. februar 2006 kastede de hende ned i brønden i et forsøg på at skjule forbrydelsen. En obduktion vil afgøre, om hun stadig var i live på dette tidspunkt. Den kendsgerning, at hendes krop ikke blev fundet flydende i brønden, men liggende på bunden, indikerer, at hun døde af drukning.

OM REAKTIONERNE OG DEN GENERELLE TRANSFOBI
Sagen blev omfattende omtalt i de portugisiske media den 23. og den 24. februar på en uhyre tendentiøs og fejlbehæftet måde.

Selv om enkelte media omtalte hende som “transvestit“, så omtalte de fleste udelukkende hendes status som “hjemløs” eller “hjemløs narko-luder”. I visse sammenhænge blev Gisberta omtalt som Gisberto, som var hendes mandlige, officielle navn. I sammenhæng med disse udeladelser – og før der var kendskab til nogen som helst detaljer om forbrydelsen og offerets identitet – fremkom adskillige aviser gennem artikler, klummer og udtalelser fra meningsdannere (som på forhånd var kendte i Portugal for deres modstand mod LGBT-rettigheder) med ytringer, som støttede, at denne forbrydelse ikke kunne komme ind under begrebet “hadforbrydelse“, og at det ikke ville være korrekt at antage, at Gisbertas transseksualitet spillede en rolle for forbrydelsen. De allerfleste hæftede sig derimod mere ved gerningsmændenes lave alder.

På samme tid blev pressemeddelelser fra de portugisiske LGBT-sammenslutninger, herunder Panteras Rosa og trans-sammenslutningen (@t) ignoreret, hvilket stadig er tilfældet. Disse pressemeddelelser beskæftigede sig med at belyse begrebet “transseksualitet” og med offerbeskrivelse, idet de kræver såvel lovgivningsmæssige som sociale tiltag for at forhindre “hadforbrydelser” begrundet i kønsidentitet, seksuel orientering, social status, sygdom og nationalitet. Der var dog spredte henvisninger til en solidatitets-demonstration – et borgerinitiativ støttet af LGBT-sammenslutningerne – den 24. februar om aftenen. Igen blev sammenslutningernes argumenter om, at offerets transseksualitet samt den transfobiske diskrimination skulle inddrages som grunde til forbrydelsen, ignoreret af medierne.

Idet man undgik at nævne “hadforbrydelse” i sammenhæng med de skyldiges lave alder undlod alle politiske partier – på nær enkelte politikere, som udtrykte deres personlige opfattelse – at udtale sig eller endsige fordømme forbrydelsen. Den eneste reaktion fra regeringen kom fra ministeren med ansvar for institutioner for unge under den kriminelle lavalder. Han udtrykte blot en “følelse af chok” uden yderlige kommentarer, og krævede en undersøgelse af den institution hvor drengene boede. Drengene – på nær en 16 årig dreng, som allerede er kriminelt ansvarlig og er indsat i varetægtsfængsel – blev sendt tilbage til institutionen og bor under relativ frihed. Der blev så vidt vides ikke taget nogen andre tiltag overfor de skyldige. Som for eksempel psykologhjælp til den 10-årige?

De fleste aviser undlod at vise billeder af den dræbte. Medierne og meningsdannerne fokuserede deres “chok” over forbrydelsen i retning af de skyldiges lave alder og ikke en borgers død. De fremkom med beskyldninger mod den præst, som leder institutionen for mindreårige, og beskrev, at en dreng fra institutionen var blevet misbrugt af en pædofil, hvilket skulle tjene som “formildende omstændigheder”. Disse oplysninger førte ikke til nogen form for offentlig reaktion. I modsætning til, hvad der er normalt, blev de oplysninger, som fremkom den 24. februar vedrørende offerets udsættelse for seksuel chikane samt oplysningerne om at Gisberta muligvis var i live, da hun blev smidt i brønden, kun bragt i en enkelt af Oports aviser.

Kun fire dage efter forbrydelsen blev kendt, er mediernes tavshed så godt som fuldkommen, og det ser meget ud til, at det fortsat vil være tilfældet.

We have just known that Gisberta, brasilian imigrant, transexual, HIV positive, drug user, sex worker and homeless, was found dead on the 22th of February in an unfinished building in the city of Oporto, and that the crime was confessed by a group of 14 boys, aged from 10 to 16 years old, most of them coming from a child protection institution.

We were also informed that the victim had a deeply fragile health condition, and she was frenquently chassed by these boys, with insults and harassment.

That on the 19th, a group of this boys entered the unfinished and abandoned building where Gisberta was staying, tied her up, gagged and assaulted her with extreme violence, kicking her, and beating her up with sticks and stones. That the group also confessed to have introduced sticks in Gisberta’s anus, whose body presented great injuries, and have abandoned her at the scene. That her body presents also cigarette burning marks. That on the 20th and 21st, they have returned to the scene and repeated the aggresions. That by dawn, from the 21st to 22nd, they finnally threw her to the pit, attempting to hide the crime. That the autopsy will clarify if she was still alive, since her body wasn’t floating, yet submerged in the bottom of the pit, indicates that she died drowned.

This case was widely spread by the portuguese media on the 23rd and 24th in a biased and erroneous way. While some of the portuguese media mentioned the murder of a “tranvestite”, most of them mentioned only her “homeless”, or “homeless, sex worker, drug addict ” condition. Gisberta was, also in some media, called Gisberto, her (masculine)legal name. According with this omition, and even before any details about the murder or about the identity and personal caractheristics of the victim were knowed, many newspapers, in opinion columns, printed articles from opinion-makers (already knowed in Portugal for their personal oposition to LGBT rights), defendind that this couldn’t be considered as a “hate crime”, and that it wouldn’t be legitim to consider any connection with Gisberta’s transexuality amoung the motivations to the crime. Usually, the arguments were around the under age of most agressors.

We have also known that at the same time were, and still are, being ignored by the media the press releases of the portuguese lgbt associations, including the Panteras Rosa and the trans association (@t), clarifying the “transexuality” and victims identity, demanding legal and social measures against discriminations and protection against hate crimes motivated by gender identity, sexual orientation, social condition, disease or national origin, though it was vaguelly mentioned a solidarity vigilance (a citizen’s iniciative supported by the lbgt associations) in the 24th evening, but, once again, the media ignored the arguments of the associations, asking the transexuality of the victim to be mentioned, as well as the transphobic discrimination as one of probable crime motivations.

It becomes clear that, by avoiding mentioning “hate crime” with the argument of the under age of the agressors, with the exception of a few oliticians that expressed their personal opinion, no portuguese political party as such took a stand nor condemned this crime. From the Government, the only reaction came from the minister responsable for this under age institutions, that simply stated “the feeling of shock”, without any more words or comments, and demanded an inquiry to the institution where the agressors were. These, with the exception of a 16 year boy, already criminaly responsable and who is alrealy in preventive inprisionment, were sent back to the institution and are in a semi-liberty regime. None other measure is known to be taken towards the agressors. Psicological support for the 10 year old boys, for example?
  1. We find odd that no photo of the victim was printed in most newspapers. The media and the opinion-makers focused the “shock” of the crime in the under age of the agressors, and not in the death of a citizen. They gave voice to insinuations of the responsable priest for the under age institution, that even said publicly that a boy from the institution was being “abused” by a pedophile, and this would be a “extenuating circumstance”. These declarations didn’t lead to the publication of any reaction. Contrary to the current praxis, the data revealed on the 24th about the victim’s sexual harassment, aswell the possibility of Gisberta being still alive when she was throwed at the pit, were only printed by an Oporto’s newspaper. Only four days after the crime was denounced, a sudden media silence about it is almost absolut, and everything

Facing a terrible murder that configurates as a most likely hate crime, facing tendencious omitions of the sexual and transphobic component of the crime, facing an aparent mediatical and political attempt of devalorizing of the crime itself, facing the omition of the “hate” component in the death of a person that acumulated so many social exclusions, facing attempts to responsabilise the victim, and publicly silencing this case, we came this way to express:
  3. our complete solidarity with the victim and the portuguese activists that are trying to clear the facts and honour the memory of Gisberta, and demading prevention and combat measures against the discrimations, without excludind protective legistation against the transphobic, lesbophobic, homophobic and biphobic discrimination and violence;
  4. our demand of respect for the positions defended by the same activists and efectivation of the measures that they have been defending as urgent;
  5. our complete incomprehension of the way the portuguese political responsable and media are dealing with the crime, of the manipulation of the facts and the absence of adequate answers to the described situation.
  6. A situation that, being confirmed, represents a total desrespect for the most elementar humam rights, that cannot be qualified only as unnaceptable in a country of the European Union, XXI century.
